Mugabe Raises Accountability Concerns Over AFC Privileges
Likuyani Member of Parliament Hon. Innocent Maino Mugabe has questioned whether the Ethics and Anti-Corruption Commission (EACC) would retain the power to investigate corruption cases involving the Africa Finance Corporation (AFC) if the institution is granted special privileges and immunities.
Mugabe raised the issue during a sitting of the National Assembly Committee on Delegated Legislation on Thursday, 8th October 2026, at Bunge Tower.
The Committee, chaired by Ainabkoi MP Hon. Samuel Chepkonga, was scrutinising two proposed legal instruments: the Privileges and Immunities (Africa Finance Corporation) Order, 2026, and the Privileges and Immunities (Ford Foundation) Order, 2026.
Prime Cabinet Secretary and Cabinet Secretary for Foreign and Diaspora Affairs Hon. Musalia Mudavadi appeared before the Committee to defend the proposals.
Members sought assurances that granting privileges to AFC and the Ford Foundation would not undermine Kenya’s sovereignty, accountability systems or the rule of law.
Mugabe specifically asked whether the EACC would still have the authority to intervene in cases of corruption under the proposed framework.
The Committee was informed that AFC would operate in compliance with Kenyan laws under an arrangement similar to that given to diplomatic missions.
AFC Director Mr. Fola Fagbule urged Members to support the Order, saying the Corporation’s presence in Nairobi could unlock major economic opportunities. The proposed framework would allow AFC to establish its first regional office outside Lagos in Nairobi, with plans to attract approximately KSh 260 billion in additional investment.
Mudavadi emphasised that Kenya should maximise investment opportunities arising from major infrastructure projects, particularly LAPSSET in Lamu.
The Committee stressed that any privileges granted must be clearly defined and should not compromise Kenya’s oversight institutions.
Questions on the ground:
Why is the Africa Finance Corporation being granted special privileges and immunities?
Has any Kenyan company ever been granted similar immunity?
Will these privileges limit the ability of Kenyan institutions like EACC to investigate wrongdoing?
What tangible benefits will ordinary Kenyans get from AFC setting up in Nairobi?
Stay informed. Stay ahead.
